Terms of Service

These Terms of Service ("Terms") govern your use of TruTap™ ("TruTap," "we," "us"), including our website at trutap.co and our NFC review products. By creating an account or using our service, you agree to these Terms, along with our Privacy Policy. If you don't agree, please don't use TruTap.

1. Who can use TruTap

You must be at least 18 years old and able to enter into a binding contract to use TruTap. If you're using TruTap on behalf of a business, you confirm you have authority to bind that business to these Terms. You also confirm that the information you give us is accurate and that you'll keep it up to date.

2. Your account

To claim a card and set a destination, you'll create an account. You're responsible for everything that happens under your account and for keeping access to the email address you sign in with secure. Don't share your account with others. Let us know promptly at contact@trutap.co if you believe your account has been compromised.

3. Products and the redirect service

Each TruTap card carries a single fixed link with a unique serial number. When you claim a card, you set the destination it redirects to, such as your Google review page. You can update that destination from your account at any time.

You're responsible for the destination you choose and for having the right to send visitors there. We may disable a card or destination if it's used in violation of these Terms or the law.

We work to keep TruTap running smoothly, but we don't guarantee uninterrupted or error-free availability. We may update, add, or remove features, and we may suspend the service for maintenance or for reasons outside our control.

4. Acceptable use

You agree not to use TruTap to:

• Point cards to unlawful, deceptive, harmful, or infringing content.
• Collect reviews in a way that violates Google's policies, FTC guidance, or applicable law, including fake, incentivized, or selectively filtered reviews.
• Impersonate another business or misrepresent who you are.
• Resell, rent, or redistribute the service without our written permission.
• Interfere with, attack, reverse engineer, or attempt to gain unauthorized access to the service.

We may suspend or terminate access for any violation, and we may report unlawful activity to the appropriate authorities.

5. Intellectual property

The TruTap name, logo, product designs, and website content belong to TruTap and are protected by intellectual property laws. You may not copy, modify, or use them without our written permission.

The content you add stays yours. By adding it, you grant us a limited, non-exclusive license to use it as needed to operate the service for you, and you confirm you have the right to provide it.

6. Third-party services

TruTap relies on third-party services, including Google, Supabase, Vercel, and Shopify, and our products send visitors to destinations we don't control. Those services are governed by their own terms and policies. We're not responsible for their availability, changes, decisions, or actions, including how Google displays, moderates, or removes reviews for your business.

7. Disclaimers

TruTap is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

TruTap is a tool that makes leaving a review easier. We don't guarantee any specific number of reviews, any rating, any search ranking, or any business result. Results depend on your customers, your business, and factors outside our control.

8. Limitation of liability

To the fullest extent permitted by law, TruTap is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, lost reviews, lost data, or business interruption, arising from or relating to your use of the service.

Our total liability for any claim relating to TruTap is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless TruTap and its owners from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of the service, the destinations you set, your review collection practices, your violation of these Terms, or your violation of any law or third-party rights.

10. Termination

You can stop using TruTap and close your account at any time. We may suspend or end your access if you violate these Terms, if your use creates risk or harm, or if required by law. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will continue to apply.

11. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in that state, and you and TruTap consent to that jurisdiction.

Before filing anything, please email us at contact@trutap.co. Most issues can be sorted out quickly and informally, and we'd rather solve it than argue about it.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we'll revise the "Last Update" date above. Continuing to use TruTap after changes take effect means you accept the updated Terms.
